Since writing this article over a decade ago, I have learned that the facts of the Notre Dame case discussed in the article were significantly different from what I had been led to believe. My source for the information was a member of the Philosophy Department at Notre Dame, but I now know that the situation was quite unlike what the article describes. Among other things, the professor in question did not threaten to sue Notre Dame--a not inconsiderable detail.

Although I continue to support, at least in broad outline and with some qualifications, the principle defended in the article, I regret any inconvenience or difficulty my incorrect description of the Notre Dame example may have caused. The principals involved have my apologies.
