re: Acquittal of Haywood

I believe the record shows that it was Judge Fremont Wood’s scrupulous instruction to the jury–that Idaho law would not recognize the uncorroborated testimony of a single witness to be sufficient evidence of alleged guilt–that was instrumental in the verdict to acquit Haywood.

The State’s case was hopelessly weak since Simkins (and other associates of Horsley/Hogan/Orchard) could not be located and forced to testify.

Haywood was no doubt crooked as a dog’s hind leg, but it was a lack of evidence, not jury fear of union reprisal, that forced the verdict.
