re: Acquittal of Haywood 

David Kendrick,

I believe the record shows that it was Judge Fremont Wood&#039;s scrupulous instruction to the jury--that Idaho law would not recognize the uncorroborated testimony of a single witness to be sufficient evidence of alleged guilt--that was instrumental in the verdict to acquit Haywood.

The State&#039;s case was hopelessly weak since Simkins (and other associates of Horsley/Hogan/Orchard) could not be located and forced to testify.  

Haywood was no doubt crooked as a dog&#039;s hind leg, but it was a lack of evidence, not jury fear of union reprisal, that forced the verdict.
