   Why The differences between these resources: Air v. Water.
   1) Availability: That air is plentiful relative to its&#039;demand explains, why the water ownership is more scrutinized/legislated than is air.
   2) Qulaity: The ease at which water can be diminished below a usable state (drinking) is far easier than air. The natural process cleaning oxygen from human the bi-product (CO2), is easier than natures ability to clean used (polluted) water back to a drinkable state.   

    3) Title to land: Whether a water body is navigable-in-fact, settles title disputes between private/public boundaries and therefore public access.   While airspace near the ground remains in private hands, all airspace above 500ft is &#039;public&#039;.  So while airspace disputes have little effect on landowners ability to use their land or exclude others, water ownership alters the ability of landowners to exclude the public and is therefore exhaustive of private rights.</description>
